In the case of an intestate succession or a succession with a will in which the testator failed to designate an executor or if the person named in the will is unable to act, the Civil Code of Quebec grants the heirs the right to appoint an executor to administer the estate. If such appointment is not made, the heirs must act collectively to settle the succession.

The appointment of the executor is subject to the rules of the Civil Code of Quebec. However, these rules may vary depending on the wording of the will and the powers that are intended to be conferred on the executor.
