Upon the death of the owner, a co-owner, a mortgage creditor, or a mortgage creditor, the executor of the deceased's estate must file a transmission declaration with the Chief Registrar indicating who the heirs are.

The shares of an owner are transferred to their heirs.

The shares of an undivided co-owner who dies pass to the surviving joint co-owners, regardless of a will.

Such a change must be reported to the registrar in order to protect their rights.

After verifying the documents submitted by the executor and updating the registry, the Registrar will issue a new registration certificate for the building, if necessary.

Given the complexity of the system, it is important to consult Notaire-Direct because:

  • The practicing notary must have liability insurance;
  • The notary is a specialist in estate liquidation and the drafting of contracts and transmission declarations;
  • The notary is a specialist in title searches and can therefore verify the validity of the title and any encumbrances affecting it;
  • The notary is obligated to verify the identity of the parties involved.
