A revision of your will may be opportune. Your family and financial situation has evolved and the different applicable laws have been modified since its drafting. The notary, being an experienced legal professional in estate planning, can advise you so that your will reflects your wishes while respecting the law and simplifying the task for the person who will settle your estate.

The fact that you are married or in a civil union will have consequences on the distribution of your assets in the event of death. If you have children and die without a will, your spouse will receive one-third of your assets (after settling the family patrimony and your matrimonial regime), and the remaining two-thirds will be devolved to your children

If you have no children and die without a will, your spouse will receive half of your assets (after the distribution of the family patrimony and marital regime), and the other half will go, depending on the case, to your brother(s) and sister(s), father and mother, nieces and nephews, etc.

The preparation of wills is therefore an important gesture. The will allows you to identify your heirs, your specific legatees, choose your liquidator, indicate your preference for guardians for your minor children. The will also allows you to engage in tax planning to save taxes and include certain specific clauses to protect your heirs, such as the non-attachability clause that will make the assets you leave to your heirs unattachable, or by creating trusts under a testamentary trust for the purpose of protecting vulnerable heirs.
